1. Data controller

FP Consultancy is the data controller for the processing activities described in this policy.

2. What personal data do we process?

Depending on your relationship with FP Consultancy, we may process:

• name, job title, company, email address and other contact details,
• the content of your enquiry and subsequent correspondence,
• information relating to proposals, agreements, deliverables, meetings and project activity,
• invoice, payment and accounting information,
• materials and data made available by a client in connection with an engagement, and
• limited technical information that the hosting provider may record for operational and security purposes, such as IP address, time, browser type and the requested page.

Do not send Danish civil registration numbers (CPR), health data or other sensitive or confidential information by ordinary email unless we have agreed an appropriate secure channel in advance.

3. Purposes and legal bases

Enquiries and proposals

We use your information to answer questions, clarify needs and prepare proposals. The legal basis will normally be steps necessary prior to entering into a contract under GDPR Article 6(1)(b), or our legitimate interest in communicating with prospective clients and business partners under Article 6(1)(f).

Clients, suppliers and business partners

Information is processed to enter into and administer agreements, provide advisory services, document the work, invoice and follow up. The legal bases are the contract under Article 6(1)(b) and our legitimate interest in sound project and relationship management under Article 6(1)(f).

Accounting and legal obligations

Invoices and other accounting records are processed to comply with bookkeeping, tax and other legal requirements under Article 6(1)(c).

Operations and security

Technical log information may be processed to operate, troubleshoot and protect the website against misuse. The legal basis is our legitimate interest in maintaining a stable and secure website under Article 6(1)(f).

4. Recipients and processors

Information is disclosed only where relevant and lawful. It may be processed by providers of hosting, email, accounting, security and other IT services. The website and company email are hosted by Simply.com A/S.

Information may also be disclosed to accountants, lawyers or other professional advisers where necessary, and to public authorities where we are legally required to do so.

If FP Consultancy processes personal data on behalf of a client as part of an engagement, a separate data processing agreement will be entered into where required. A data processing agreement is therefore not a general public website term.

5. Transfers outside the EU/EEA

FP Consultancy aims to use providers that process data within the EU/EEA. If a provider in a specific situation transfers personal data outside the EU/EEA, the transfer must rely on a valid transfer mechanism and appropriate safeguards under applicable data protection law.

6. Retention periods

We do not retain information longer than necessary:

• Enquiries that do not result in a collaboration are generally deleted no later than 12 months after the dialogue has ended.
• Client and project materials are retained during the engagement and generally for up to 3 years after completion, unless documentation requirements, a potential legal claim or a specific agreement requires longer retention.
• Accounting records are retained for the legally required period, normally 5 years from the end of the relevant financial year.
• Technical logs are retained for a limited period determined by operational, troubleshooting and security needs.

Information may be retained for longer where necessary to establish, exercise or defend a legal claim.

7. Your rights

Depending on the circumstances, you may have the right to:

• access the information we process about you,
• rectification of inaccurate or incomplete information,
• erasure or restriction of processing,
• object to processing based on legitimate interests, and
• data portability where the applicable conditions are met.

These rights are not absolute and may be limited by, for example, documentation, accounting or legal-claim requirements. Write to info@fpconsultancy.dk, if you wish to exercise a right.

8. Complaints

Please feel free to contact us first if you are dissatisfied with our processing. You also have the right to lodge a complaint with the Danish Data Protection Agency.

9. Automated decision-making and profiling

FP Consultancy does not use the information described here for automated decision-making or profiling that produces legal effects or similarly significantly affects you.

10. Changes

This policy will be updated if the website’s functionality, suppliers or our processing of personal data changes. The current version will always be available on this page.
